General Terms and Conditions of Sale

DISCLAIMERS:

Anyone using the Hotel Perpetual website for reservation purposes must be at least 18 years old and have the capacity to enter into contracts in accordance with the law. The client can reserve, individually and for personal needs, a maximum of nine (9) rooms per reservation on the website. For group reservations related to business, meetings, seminars, or others, please visit the "Meetings & Events" section of the Hotel Perpetual website. For any reservation identified on the site for more than nine rooms, the hotel reserves the right to modify the price and general terms of sale. Any irregular, ineffective, incomplete, or fraudulent reservation or payment attributable to the client will result in the cancellation of the reservation at the client's expense, without prejudice to any civil or criminal action against the client.

ARTICLE 1: OBJECT

These general terms and conditions of sale define the rights and obligations of the parties in the context of the distance reservation of services offered by Hotel Perpetual. They apply to all reservations made via the Hotel Perpetual website.

ARTICLE 2: GENERAL PROVISIONS

These general terms and conditions of sale apply for the entire duration of the services being offered by Hotel Perpetual on the website. Hotel Perpetual reserves the right to supplement or modify these general terms and conditions of sale at any time by publishing a new version on its website, which will automatically apply upon publication. The applicable general terms and conditions of sale are those in effect on the date of the reservation.

ARTICLE 3: CONCLUSION OF THE ONLINE CONTRACT

3.1. Choice of services by the client: The client chooses the services presented under their sole responsibility, and Hotel Perpetual's responsibility cannot be sought. The client ensures the nature, destination, and booking conditions. The client acknowledges that they have received the necessary advice and information to ensure the adequacy of the offer to their needs before making a reservation.

3.2. Reservation process: The client makes their reservation through the dematerialized order form accessible on the site. The client attests to the truth and accuracy of the information provided. The client must follow a series of steps to make their reservation, including searching for stay dates, room category, and rate; optional selection of one or more additional services such as breakfast (unless included in the rate mentioned earlier); verification of the reservation details, total cost, and applicable sales conditions (general and specific); entering client details; entering credit card data in case of a guarantee or prepayment request; reviewing and accepting the general and specific sales conditions of the reserved rate before validating the reservation; and finally, validating the reservation.

3.3. Reservation acknowledgment: An email acknowledgment of the reservation is sent to the client. It summarizes the contract offer, reserved services, prices, the total amount of the order, sales conditions related to the selected rate accepted by the client, and the reservation date.

3.4. Formation of the reservation: The reservation is deemed to be formed upon confirmation of the reservation or during online prepayment by credit card.

ARTICLE 4: PRICES

The prices for the reservation of services are indicated on the site and confirmed during the reservation. The prices are per room for the number of person(s) and the selected date. Prices are confirmed to the client in total, including taxes, in the hotel's commercial currency and are only valid for the duration indicated on the site. If the hotel debit is in a currency other than that confirmed on the reservation, the exchange fees are the client's responsibility. All reservations are payable in the hotel's local currency, unless otherwise specified on-site. Unless otherwise stated on the site, additional services (breakfast, Spa access, etc.) are not included in the price and are displayed separately. The tourist tax, presented on the rates page, is to be paid directly at the hotel. Prices include the applicable VAT on the day of the order. Any change in the applicable VAT rate will automatically be reflected in the prices indicated on the invoicing date. Likewise, any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the invoicing date. The conversion into foreign currency is indicative and non-contractual. Only the currency confirmed during the reservation is guaranteed. If a rate implies that payment is made at the hotel upon arrival or departure, and the client's currency is different from that of the hotel, the hotel's debited rate may differ from that communicated during the reservation, considering the possible exchange rate fluctuations between the reservation date and the hotel stay dates.

ARTICLE 5: PAYMENT

The client provides their credit card details as a reservation guarantee, unless otherwise specified by special conditions or rates, by credit or private card (Visa, Mastercard, American Express, Diners Club...) by entering the card number, expiration date (the credit card must be valid at the time of stay), and visual cryptogram directly in the area provided for this purpose (secure entry by SSL encryption). The client must present themselves at the hotel with the credit card that was used to guarantee the reservation or make the prepayment. The hotel may ask them to present identification for the purpose of credit card fraud prevention. Payment is debited at the hotel during the stay, except for special conditions or rates where payment is debited during the reservation (online prepayment on certain rates). This prepayment is referred to as a deposit. In the case of a non-prepaid online rate, the hotel will ask the client, upon arrival, for a security deposit or authorization to debit the credit card to guarantee payment for services consumed on-site. In the event of a no-show (non-cancelled reservation – client not present) for a reservation guaranteed by a credit card, the hotel will debit the client, as a lump-sum indemnity, the amount of the first night on the credit card provided as a reservation guarantee, and any additional nights of the reservation will be canceled without charge unless otherwise indicated in the sales conditions of the reserved rate. The client, by making a reservation, expressly authorizes the hotel to proceed with the payment of the lump-sum indemnity. At the time of prepayment, the amount debited during the reservation includes: the accommodation price, taxes related to accommodation, the price of catering if breakfast is chosen, taxes related to catering, and any other additional services selected by the client. In the case of a rate subject to online prepayment, the amount paid in advance, which is the deposit, is debited at the time of reservation.

ARTICLE 6: CANCELLATION OR MODIFICATION BY THE CLIENT

In accordance with Article L 121-21, 12° of the Consumer Code, the client does not have the right of withdrawal provided for in Article L 121-21 of the Consumer Code. The sales conditions of the reserved rate specify the cancellation and/or modification terms of the reservation. Reservations with prepayment cannot be subject to any modification and/or cancellation. Amounts paid in advance, such as deposits, will not be refunded. In this case, it is mentioned in the sales conditions of the rate. When the sales conditions of the reserved rate allow it, the cancellation or modification of the reservation can be made directly with the hotel, whose telephone contact details are specified on the reservation confirmation sent by email. In the event of an interruption of the stay, the full agreed-upon price will be collected. In the case of a pre-paid reservation online, no refund will be granted for this reason. Unless expressly stated otherwise, the client must vacate the room before 12:00 on the day of the end of the reservation. Otherwise, they will be charged an additional night. Each reservation is nominative and cannot, under any circumstances, be transferred to a third party, whether free or for consideration.

ARTICLE 7: DISPLACEMENT

In the event of an exceptional event or impossibility to make the reserved room available to the client or in case of force majeure, the hotel reserves the right to accommodate the client in an equivalent category hotel for services of the same nature, subject to having previously informed the client.

ARTICLE 8: STAY AT THE HOTEL

In accordance with French regulations, the client must fill out a police form upon arrival, presenting identification if necessary. The client must comply with the Hotel's Internal Regulations available at the Reception. In the event of non-compliance, the hotel reserves the right to ask the client to leave without compensation or to charge the full stay if no payment has yet been made. Hotel Perpetual offers free WIFI access, but the client agrees not to use computer resources for illegal purposes.

ARTICLE 9: DISCLAIMER

The photos on the site are not contractual. The hotel cannot be held responsible for inaccuracies due to changes in furniture or renovations. In case of force majeure, the hotel declines all responsibility.

ARTICLE 10: HOTEL CANCELLATION / ERRORS

The site may contain technical errors. The hotel reserves the right not to honor reservations affected by such errors.

ARTICLE 11: COMPLAINTS

Any complaint must be addressed to Hotel Perpetual in writing within eight days of departure. For complaints related to reservations, the Customer Service is available in the "Contact us" section or by mail to the address indicated.

ARTICLE 12: FORCE MAJEURE

Force majeure suspends the performance of reciprocal obligations. Each party bears the costs arising from force majeure.

ARTICLE 13: RESPECT OF PRIVACY

The client authorizes the communication of their data to third parties for contract execution. The client can oppose the use for prospecting purposes.

​

ARTICLE 14: PROOF AGREEMENT

Entering banking information and accepting conditions constitutes an electronic signature. The computerized records of the hotel are considered proof of communications and payments.

​

ARTICLE 15: ACCOUNT / PASSWORD

The client is responsible for the confidentiality of their login data.

​

ARTICLE 16: DISPUTE RESOLUTION

The contract is governed by French law. In the event of a dispute, the Paris High Court is competent after attempting amicable resolution. The priority contractual documents are the reservation form and the general conditions. In the event of a contradiction, the reservation form prevails.
